Terms of Service

# Terms of Service Last updated: 20 October 2026 1. Who we are, and what this site is Inspected Carsales (ABN 32 472 677 030) runs an online marketplace for vehicles. Every vehicle listed publicly is meant to have an independent inspection that we arrange. By using the site, or creating an account, you agree to these terms. If you do not agree, please do not use the site. We are a platform. We are not the seller of any vehicle, we are not a party to a sale between a seller and a buyer, and we do not set the price a seller asks. 2. Your account - You must give accurate information and keep it up to date. - Keep your password secure. You are responsible for what is done through your account. - You must be at least 18 and able to enter a binding contract. - Tell us straight away if you think someone else has used your account. 3. Listings - A seller must own the vehicle or be authorised to sell it, and must describe it honestly and accurately, including its condition, history and any known faults. - A seller must not hide, misdescribe or leave out information a buyer would reasonably want to know. - A listing is not made public until its inspection is done, unless we have told you otherwise. We may remove, close or pause a listing that breaks these terms, is inaccurate, or is under review (see section 9). - You may not use the inspected badge, or any report, in a way that suggests more than the report says. For example, you may not say a vehicle is "certified", "roadworthy" or "guaranteed" because it has been inspected. 4. Inspections - A seller books and pays for an inspection through the site. The booking terms shown at the time of booking are the contract for that inspection. - We arrange the inspection and engage an independent mechanic to carry it out. The mechanic's findings are recorded in a written report. - The report is shown on the listing. Anyone with the link to a report can read it and download it. 5. If you are reading an inspection report (buyers and visitors) - A report records what the mechanic found on the date and at the time of the inspection. The vehicle can change afterwards. - Unless the report says otherwise, the inspection is visual and non-invasive. Hidden, intermittent or developing faults may not be found, and items marked Not Checked were not examined. - A report is not a roadworthy or safety certificate, a warranty, or a promise about the vehicle's future reliability or value. It does not replace your own checks, a full mechanical inspection if you want one, or the proper checks before buying a vehicle (for example a check for money owing and a history check). - We do not guarantee that a vehicle is as described by its seller, and we are not responsible for a seller's description or price. - If you think a report is wrong or misleading, use the "Report a problem" link on the report. A person reviews every complaint. ## 6. Sales between users Any sale is between the seller and the buyer. We do not take part in it, take payment for the vehicle, or hold it. Buyers should check the vehicle and the seller's right to sell it before paying. We are not responsible for how a seller or buyer behaves, or for the outcome of a sale. Nothing here limits any right a buyer has against a seller under the law. 7. Dealer subscriptions - A dealer account needs our approval before it is used. We may decline or end a dealer account. - A dealer pays a monthly subscription at the price shown when the dealer subscribes (in Australian dollars), taken through Stripe on the same day each month. - If a payment fails and the account remains overdue for 14 days, the dealer's listings are hidden until the account is paid. They are shown again once payment is made. - A dealer can manage or cancel the subscription from the billing portal in their account. Cancelling takes effect at the end of the month already paid for, and we do not refund part of a month unless the law requires it. We give at least 30 days' notice of a price change. 8. Rules of use You must not: - break the law, or use the site to deceive, harass or harm anyone; - post anything false, misleading or defamatory, or anything you do not have the right to post; - copy or collect other people's personal information from the site, or use the site to send unwanted messages; - try to interfere with how the site works, get around its security, or access something you are not meant to; - change, forge or misuse a report, or offer or accept money to change a finding. 9. Our right to act, and complaints - We may remove content, close or pause a listing, suspend a report or an account, or end an account, if we reasonably think these terms are being broken, a report or listing may be wrong or misleading, or there is a safety, fraud or legal concern. - When we do this while we look into a complaint, it is temporary. It is not a finding that anyone did anything wrong, and we will lift it when the matter is resolved. - We follow a written complaints and suspension procedure, which is on our website on the Complaints page. A person reviews each matter, and we tell the people involved the outcome. 10. Content you give us - You keep ownership of what you post (such as photos and descriptions). You give us a non-exclusive licence to show it on the site, and in reports and promotional material about the site, for as long as it is on the site. - You promise you have the right to give us that licence. 11. Third-party services The site uses services provided by others, including our hosting, payment (Stripe), email and marketplace software providers. Their own terms apply to how they handle information. We are not responsible for their services. 12. Our responsibility - The site and its content are provided as they are. We try to keep it available and accurate, but we do not promise it will always be, or that it is free of errors. - Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. If any part of these terms would have that effect, it is to be read down so that it does not. - We are not responsible for what sellers, buyers or other users say or do, or for services provided by others, except where the law makes us responsible. 13. Privacy How we collect, use, share and keep personal information, and how to ask to see or correct it, is explained in our Privacy Policy, which is on our website. Our use of cookies is explained there too. 14. Closing your account You can ask us to close your account at any time, from your profile settings or by contacting us. Closing it does not cancel a payment owed, or a booking already under way, and we may keep records where the law or a complaint requires. 15. Changes to these terms We may update these terms. If a change is material we will tell you, for example by email or a notice on the site, before it applies. If you keep using the site after a change takes effect, you accept it. 16. Contact and general - Contact us at admin@inspectedcarsales.au. - These terms are governed by the laws of Queensland, Australia, and you and we submit to the courts of that State and the Commonwealth courts that sit there. - You cannot transfer your rights under these terms without our written consent. If any part of these terms is found to be unenforceable, the rest still applies. Email: admin@inspectedcarsales.au
